HŽ Infrastruktura – lack of standing to act
The Croatian Competition Agency (CCA) received an anonymous complaint regarding the alleged infringement of competition rules by the undertaking HŽ Infrastruktura d.o.o. within the meaning of Competition Act.
The anonymous complainant basically stated in its initiative that HŽ Infrastruktura has violated competition rules in the transport market, particularly in the area of rail and truck transport by allowing only one company – HŽ Cargo d.o.o. to do business without settling the electric current for traction charges and the rail track costs.
After having carried out the preliminary market investigation the CCA found that HŽ Infrastruktura has been actively engaged in settling the debt of HŽ Cargo, which has been substantiated by the relevant documents delivered to the CCA. The analysis of the documents concerned lead the CCA to the conclusion that HŽ Infrastruktura has not put HŽ Cargo in a more advantageous position than other users of cargo transport in the market. Therefore, the CCA dismissed the complaint concerned.
