UTPs infringement proceedings against PLODINE re-seller

In line with the Act on the prohibition of unfair trading practices in the business-to-business food supply chain (UTPs Act) the Croatian Competition Agency (CCA) opened an administrative proceeding against the company PLODINE d.d. after having examined the unclear and possibly contestable provisions in one of the contracts concluded between the company concerned and its suppliers.

The above indices suffice to open the infringement proceeding where the CCA will investigate all the elements relating to the nature and the contents of the business deals in question.

The CCA notes that the mere opening of an infringement proceeding against a re-seller, buyer or a processor does not mean that the alleged practices necessarily constitute unfair trading practices and thereby an infringement of UTPs provisions.

The CCA decides on the merit on a case-by-case basis, considering all the relevant facts of the case and concrete evidence that substantiate the indices on the basis of which the proceeding is opened in the first place.
