Mirta Kapural, PhD: Online lecture for students of Law Faculty Rijeka

The president of the Competition Council, Mirta Kapural, PhD, held a lecture for the students of the Law Faculty in Rijeka on 17 October 2021. The subject of the lecture was “Application of EU competition law in national practice”.

In the introductory note Ms Mirta Kapural, PhD, explained the legal basis of EU competition law, particularly Articles 101 and 102 of the Treaty on the functioning of the European Union (TFEU), the Council Regulation (EC) No 1/2003, directives and guidelines). The concepts explained included parallel application of the EU competition law (Articles 101 and 102 TFEU) and the national law (Croatian Competition Law) in the proceedings carried out by the Croatian Competition Agency (CCA). Further explained were the concepts of the uniform interpretation and application of EU law, the cooperation between the CCA and the European Commission and other national competition authorities of the EU Member States within the European Competition Network (ECN). The importance of EU practice, the decisions of the European Commission and the case law of the General Court and the EU Court of Justice for the development of the national practice in the area of competition policy were also pointed out. Finally, the paper presented the cases from the practice of the CCA where Article 102 TFEU was applied (case CCA v HT) and where committments were undertaken with effect on the practice in the neighbouring Member States (Coca-Cola).

The understanding of competition rules being one of the most important EU policies is essential for anybody who is active in the internal market, be it competitors or consumers, including the students of law who will participate in this market in pursuing their future careers.
