{"id":3305,"date":"2012-07-12T00:00:00","date_gmt":"2012-07-12T00:00:00","guid":{"rendered":"http:\/\/aztn.hr\/the-agency-initiated-a-proceeding-against-hrvatski-autoklub-hak\/"},"modified":"2022-09-19T10:08:54","modified_gmt":"2022-09-19T10:08:54","slug":"the-agency-initiated-a-proceeding-against-hrvatski-autoklub-hak","status":"publish","type":"post","link":"https:\/\/www.aztn.hr\/en\/the-agency-initiated-a-proceeding-against-hrvatski-autoklub-hak\/","title":{"rendered":"The Agency initiated a proceeding against Hrvatski Autoklub (HAK)"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>The Agency initiated a proceeding against Hrvatski Autoklub (HAK) in order to determine whether HAK distorted competition by concluding prohibited agreement with undertakings \u2013 its contractual partners.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">There are indications that by the application of the Article 7 of the \u201cRegulation on the provision of services of technical assistance to road drivers\u201d from 25 May 2011, which needs to be respected by all HAK\u2019s contractual partners or otherwise they would be penalised, HAK has distorted competition on the market of the provision of services of removal and transport of vehicles from the roads.<\/p>\n<p style=\"text-align: justify;\">Although the status and the powers of HAK are regulated by the \u201cLaw on HAK\u201d, which empowers and entrusts HAK to carry out certain public authorities, <em>inter alia<\/em> the provision of technical assistance to road drivers, the Law does not exclude a possibility for other existing or new undertakings to operate on that market. The mentioned Regulation adopted by the HAK\u2019s Board on 25 May 2011 is an internal act defining the organisation of the technical assistance system as HAK\u2019s public authority, manner of the operation of the service, conditions to be fulfilled by all stakeholders in the system, their rights and obligations, underlying work principles and the manner of charging for the services offered.<\/p>\n<p style=\"text-align: justify;\">According to the provision of the Regulation which raises competition concerns, all contractual partners concluding an agreement with HAK on the implementation of certain tasks within technical assistance to road drivers are prohibited from cooperating with other domestic or foreign entities and may not, without prior HAK\u2019s approval, conclude or have concluded agreements with other legal persons, whereby the list of such persons is determined by the HAK\u2019s Board.<\/p>\n<p style=\"text-align: justify;\">Therefore, the CCA\u2019s proceeding will serve to determine whether HAK has distorted competition by concluding prohibited agreement and to identify the implications of such agreement on competition.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Agency initiated a proceeding against Hrvatski Autoklub (HAK) in order to determine whether HAK distorted competition by concluding prohibited agreement with undertakings \u2013 its contractual partners. \u00a0 There are indications that by the application of the Article 7 of the \u201cRegulation on the provision of services of technical assistance to road drivers\u201d from 25 [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[2],"tags":[],"class_list":["post-3305","post","type-post","status-publish","format-standard","hentry","category-news"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.3 -
